ADMISSIONS POLICIES
Admissions Anti-Discrimination Policy
In the admission to our programs, we do not discriminate based on age, gender (including pregnancy), race, ethnicity, culture, national origin, religion, sexual orientation, disability, socioeconomic status, genetic information, or any other basis proscribed by law.
Application Procedures and Policy
To apply to any of our yoga teacher training and yoga therapy programs, you must be at least 18 years old. There is no deadline for applying. However, we do recommend applying with enough time to allow us to prepare for your arrival.
Please note that some of our programs have prerequisites. Before applying, please review the prerequisites listed on the program page. Also, see “Prerequisite Policy”.
Admissions Requirements and Pre-Requisites
Some of our courses require the completion of Pre-Requisite assignments. If this is the case, you will be notified by the Program Director or another staff member. If the prerequisite is not completed or not completed satisfactorily, the student will not be allowed to join the training.
200 Hour Yoga Teacher Training Pre-Req
Must be 18 years old and interested in yoga.
300 Hour Yoga Teacher Training Pre-Req:
A 200-hour Yoga Alliance registered training
One year of yoga teaching experience
One year of personal practice
You must complete our Foundations Prep Course if your 200-hour training was not with us or an affiliate school.

Due to our program's specific content and nature, we do not accept transfers from non-affiliate schools or programs.
PAYMENT AND REFUND POLICIES
Deposit Payment and Refund Policy
Deposit amounts vary by program and are due within 10 days of acceptance. If the program is scheduled to begin within 15 days of acceptance, full tuition payment (including deposit) is required.
The deposit amount is applied toward tuition for each intensive.
Deposits are non-refundable and non-transferable.
Deposit payments cannot be deferred to another course, course start, or another person.
Tuition Payment Policy
Complete tuition payment is due at least 15 days before the program start date. Tuition does not cover travel, accommodations, and meals.
A $20 late fee will be charged for payments received after the due date.
Payment options include credit/debit cards. A written request can be made for check, PayPal, and Venmo payments. A $30 fee will be charged for all returned checks.
You will be suspended from the program if you do not fulfill your tuition obligations according to policy.
Additional financial obligations may also include:
Private sessions with a staff member in the case of missed hours ($150/hour).
Tuition costs, in case of repeating an intensive (50% tuition for that intensive).
Remote training fees, in case the student can’t attend an intensive in person ($50/day).
Tuition prices may change without notice, even during the course of a program. Always reference the program page for the most recent pricing structure.
Tuition Refund Policy
Tuition is refundable (100%) if a written request is made at least 15 days before the program start date. Refunds will be issued by check or credit card refund within one month of receiving the request.
Tuition is non-refundable starting 15 days before the program start, but it may be deferred for up to one year of the program start date. See the complete “Deferral” policy below.
Room & Board Payment and Refund Policy
Room and board must be paid at least 15 days before the program start. All lodging options are available on a first-come, first-serve basis.
Room and board payments are non-refundable 15 days before the start date.
No refund will be given for any portions of meals and lodging if the student doesn’t partake.
Room and Board payments cannot be deferred to another intensive if you are within 15 days of your intensive start. See the complete “Deferral” policy below.
Commuter spaces are available if you choose not to stay at the shala. In addition to tuition, commuters pay $55 per day. The cost includes daily meals, coffee and tea, and full use of the facilities when not in program sessions. We recommend that commuters live or stay within 30 minutes due to the program schedule. While you are not required to stay at Circle Yoga Shala during your training program, the residential aspect supports the curriculum and your ability to participate fully in the rigorous schedule. This training is designed to give you time away from the regular day-to-day demands of your life and allow you to be in an environment that fully supports a yogic lifestyle. The immersion experience, which our teacher trainings are known for, brings your training to a depth that would otherwise be unattainable. In addition, staying at the shala facilitates the development of lifelong connections with fellow students.
Accommodations are refundable (100%) if a written request is made at least 15 days before the program start date. Refunds will be issued by check or credit card refund within one month of receiving the request.
When paying in full
Accommodations are non-refundable starting 15 days before the Training Starts.
If you are within 15 days of the training start, 50% of the amount of the full accommodation is transferable to the next training cycle, should the student defer (also see Deferral Policy).
Accommodation payments cannot be transferred to another student.
When paying per intensive
Accommodations are non-refundable and non-transferable starting 15 days before each intensive.
Accommodations cannot be deferred to another intensive if you are within 15 days of your intensive start (also see Deferral Policy).
Accommodation payments cannot be transferred to another student.
In the case of a weather event that moves the Intensive from ‘in person’ to being ‘online’, a credit will be issued to the students in the amount of the canceled accommodations minus a daily remote fee of $50. The credit will be valid for 3 months on select Shala experiences that are at the discretion of the staff.
Financial Aid Policy
We do not offer Financial Aid options.
“No Show” Policy
If you do not attend the program for which you are expected, your payments (deposit, tuition, lodging) will be forfeited.
Other Fees
In addition to the deposit, tuition, and accommodations, students may incur additional financial obligations for any teaching arrangements outside of the designated curriculum and policies. For example:

Students should also plan to cover their travel/transportation to and from the Circle Yoga Shala and the procurement of books and other materials required for the training.

PROGRAM COMPLETION POLICIES
Attendance Policy
Students must be prepared to attend 100% of the classroom time.
Students missing more than 80% of class meetings must retake the intensive in the time frame specified in the Graduation Policy. Tardiness and leaving class early are subtracted from the total time of the program and counted against the minimum required attendance.
Students missing less than 80% of class meetings may schedule private sessions with a Lead Trainer to make up for the lost time and content. Such arrangements must be made in writing with the Program Director before the end of the Intensive.
Any missed hours must be made up through private sessions with a Lead Trainer ($150/hour).
Students must note any inclement weather dates for winter intensives and be available to attend on those dates, should the shala need to use them.
We encourage all our students to start with the first intensive because all the material in the training layers on the concepts introduced during the first intensive.
All our courses are conducted on the property unless otherwise specified.
Grading Policy
A pass/fail system applies to all coursework. A passing grade is defined as 80% or better on all course requirements.
Academic Performance Policy
Academic progress will be monitored throughout the intensives. Progress will be measured based on:
Attendance for all required contact hours
Participation in discussion and group activities
Demonstrated ability to apply the material covered during the Intensive
Satisfactory completion of all in-class assignments, distance learning, and homework assignments, if applicable.
Satisfactory completion of the practicum evaluation and any written exams, if applicable.
Yoga Therapy and 300 Hour Yoga Teacher Training
A large part of coursework consists of Homework, Distance Learning, and/or Practicum. All assignments must be completed by the deadline given at the end of each intensive and in a satisfactory manner. Failed or incomplete assignments will result in the student having to retake the intensive.
Students may receive an Academic Evaluation at the end of each intensive. Students will work with a teacher individually on a plan to improve the student’s weaknesses and keep building on the student’s strengths. Students who do not show progress must retake the intensive.
Student academic performance is tracked throughout the course of the study. Students are required to demonstrate skills taught during classroom time each intensive.
A standardized assessment form will be provided to the student, including areas of development, if necessary. The assessment forms are available to the students on the Private Training Site.
To pass the assessment, the student must either “Meet” or “Exceed expectations”.
If the student’s performance is “Approaching expectations”, the student must work with the main trainer to develop an individualized action plan. The action plan may include additional sequencing exercises, practice teaching, home practice, and so on. If the student does not complete the action plan and/or if the student does not show progress, the student must retake the intensive until the student “Meets expectations”.
If the student’s performance is “Below expectations” or “Off-topic,” the student must retake the intensive until the student “Meets expectations”.
Marking Rubric
Exceeds expectations (5): All (100%) of the assessment areas have been met.
Meets expectations (4): More than 80% (but less than 100%) of the assessment areas have been met.
Approaching expectations (3): 50% to 80% of the assessment areas have been met.
Below expectations (2): Less than 50% of the assessment areas have been met.
Offtopic (1): It was not possible to evaluate the student’s understanding of the material.
In addition to passing the standardized assessment, students must also:
Abide by the Attendance Policy.
Participate in group discussions and activities in a constructive way.
Complete all classroom assignments in a satisfactory manner.
Complete all homework and distance learning in a satisfactory manner in the timeframe specified on the Private Training Site.
Complete all Practicum requirements, including meeting with your mentor, in the timeframe specified on the Private Training Site and in a satisfactory manner.
Failed or incomplete assignments will result in the student having to retake the intensive.
The student is responsible for all costs associated with re-taking an intensive, per the Tuition Payment Policy and the Room & Board Policy.
Graduation Policy
To graduate from a CYS program, all the conditions below must be met
All intensives and assignments must be completed within 2 training cycles.
All financial obligations must be completed.
Upon completion of the program, an official certificate will be provided free of charge to the student. Any additional certifications requested or required will carry a $10 processing fee.
Re-Enrollment Policy
Re-enrollment is required when the student cannot complete all intensives in accordance with the Graduation Policy. To re-enroll, students must have met all prior financial obligations. To re-enroll, students must re-apply and be prepared to complete the coursework in its entirety.
Withdrawal Policy
Students wishing to withdraw from the school must provide a notice in writing (email or letter) or by phone to Circle Yoga Shala, including the reason for withdrawal. The date of withdrawal shall be the date set forth in writing.
The student must return the manual, if one was provided, within 2 weeks of the withdrawal notice. Returning the manual is at the student’s expense.
All financial obligations must be fulfilled for the completed portion of the program.
Cancellation Policy
In the unlikely event of a course cancellation due to low enrollment or other unforeseen circumstances, Circle Yoga Shala reserves the right to cancel a course up to seven (7) business days prior to the start date of the course.
Please note that some intensives have pre-determined “make-up” dates in case of cancellation due to weather. We rarely ever need to use the make-up dates, but you are still responsible for keeping those dates open in case the intensive dates change.
Deferral Policy
Requests for deferral must be made in writing to the Program Director.
There is a $50 fee.
Courses can only be deferred for a maximum of 2 training cycles. If the students cannot complete all intensives in the specified time frame, they must withdraw and re-apply later.
200 Hour Yoga Teacher Training - 2 training cycles, approximately 2 years
300 Hour Yoga Teacher Training - 2 training cycles, approximately 2 years
Yoga Therapy - 2 training cycles, approximately 3 years
Any duration longer than that requires that the student re-applies to the program and re-starts the program anew.
For a student to successfully defer, all payments and all assignments (hw) must be up to date.
Deferral of payments:
Deposit payments cannot be deferred to another course or course start.
Any tuition payment in excess of the student's attendance can be deferred to the next training cycle. Excess tuition is forfeited beyond that.
Room and Board payments (one-and-done) can be partially (50%) deferred if you are within 15 days of the Training Start but must be used the next training cycle. Room and Board payments are forfeited beyond that.
Room and Board payments (one-and-done) cannot be deferred if you are within 15 days of your first intensive.
Room and Board payments (per intensive) can be deferred if you are outside of the 15 days mark but must be used the next training cycle. Room and Board payments are forfeited beyond that.
Room and Board payments (per Intensive) cannot be deferred if you are within 15 days of your next intensive.
No payments can be deferred to another student.
Transfer from/to an Affiliate School/Program
Transfers are possible from a CYS program offered at one location (such as our home in Jasper, AR.) to the same CYS program offered at a different location (such as a hosting studio in a different city). Please check the shala calendar for programs being offered at hosting locations since that is not a regular offering. A written request must be submitted to the CYS staff to transfer from one location to another. If approved, an additional 30% tuition charge must be covered for each intensive attended at the new location. If transferring from a hosting studio to the shala, the student must also cover accommodations or the commuter fee.
CONDUCT POLICIES
Student Code of Conduct
We expect that students:
Turn off cell phones during class.
Dress and behave in a professional and ethical manner.
Be respectful of trainers, staff, other students, and school property.
Arrive for each session on time and fully prepared with assignments, reading and writing materials, and appropriate gear.
Fulfill financial and time commitments to the program.
Do not enter the teaching space intoxicated or under the influence of any substance.
Exhibit excellent hygiene, and wear no obvious scents or cologne/perfume.
Dress in a manner appropriate for the practice and instruction of yoga at all times during all class sessions. The dress code consists of yoga or sports pants and yoga tops or shirts that provide coverage of the torso during movement. Students failing to comply with the dress code will be dismissed from class with an opportunity to return when in compliance.
Students who do not comply may undergo a Student Disciplinary Procedure.
Teacher Code of Conduct
Purpose Statement: Our Code of Conduct aims to help our teachers serve in their purest spirit and protect our students and community.
Financial Practices: Teachers will discuss all fees and financial arrangements in a straightforward, professional manner. Teachers will manage their business affairs according to recognized standard business and accounting practices. Teachers are encouraged to render services to individuals or groups in need without regard to financial remuneration. Teachers will neither receive nor pay a commission for the referral of a student.
Professional Growth/Continuing Education: Teachers shall dedicate themselves to the continuing study and practice of yoga, including asana, meditation, and theory.
Teacher-Student Relationships: Teachers shall demonstrate a high regard for their students' moral, social, and religious standards. Teachers shall avoid imposing their personal beliefs on their students, although they may express them when appropriate in the class and in a sensitive and careful manner. Teachers recognize the trust placed in them by students and the unique power of the student-teacher relationship. Teachers shall avoid exploiting the trust and dependency of students. Teachers shall avoid dual relationships with students (e.g. business, close personal, or sexual relationships) that may impair their judgment, compromise the integrity of the teachings, and/or use the relationship for their personal gain. Teachers shall not engage in harassment, abusive words or actions, or exploit students. Teachers recognize that the teacher-student relationship involves a power imbalance and shall exercise caution if the teacher chooses to get into a personal relationship with a student.
Integrity: Teachers shall uphold the highest of moral standards. Teachers shall strive to ensure that their intentions, actions, and speech are based on honesty, compassion, selflessness, trustworthiness, and transparency.
Scope of Practice: Teachers shall not abandon or neglect their students. If teachers are unable (or unwilling for appropriate reasons) to provide professional help or continue a professional relationship, they should make every reasonable effort to arrange for instruction for that student with another teacher. Teachers should avoid giving any personal advice concerning a student’s personal life. Teachers shall not give medical advice. Teachers shall not prescribe a treatment or suggest rejecting a physician’s advice. Teachers shall refer their students to medical doctors or complimentary licensed professionals when appropriate.
Confidential Information: Teachers shall keep all personal information disclosed by their students strictly confidential.
Inter-Professional Relationships: Teachers are part of a network of health care and well-being professionals and shall seek to develop interdisciplinary relationships. Teachers shall conduct themselves in an honorable manner in their relations with their colleagues and other wellness practitioners. Teachers shall not openly criticize practices followed by other yoga schools or teachers.
Advertising and Public Communications: A teacher shall accurately represent his or her professional qualifications and certifications along with his or her affiliations with any organization(s). Announcements and brochures promoting classes or workshops shall describe them with accuracy and grace. These principles are designed to uphold the quality of our teachings and shall be in compliance with legal guidelines for the appropriate representation of our services.
Yoga Equity: Teachers shall welcome all students regardless of age, sex (including pregnancy, gender identity, and perceived gender expression), sexual orientation, color, race, national origin, marital status, parental status, veteran’s status, religion, or physical or mental disability, provided that the teacher has appropriate expertise.
Student Disciplinary Policy
Students who fail to meet conduct expectations will be given a verbal reprimand, during which conduct policies will be reviewed. If questionable conduct continues, a second written reprimand will be shared with the student. If compliance is not maintained throughout the remaining time in the program, the student will be terminated, and a “Letter of Program Termination for Conduct Violation” will be sent to the student.
Refunds will be processed in case of student termination according to the Refund Policy.
Student Grievance Policy
We encourage anyone who has been the subject of sexual misconduct or any other action that violates our policies to report the incident to our Program Director at Circle Yoga Shala. A grievance team made up of the instructor and another member of the faculty will meet to review the issues contained in the written letter (henceforth referred to as the “reviewing body”). The report should contain the following information:
Your full name;
Your email and phone number;
The name of the person who the grievance is against;
A description of the alleged policy violation;
The date and location of the policy violation;
Names and contact information of any witnesses with first-hand knowledge of the situation; and,
Any other credible evidence that is available to support the grievance
In the interest of fairness and privacy, all reports must be made by the person who has personally experienced the misconduct. We will not investigate a matter based on a third-party report of misconduct. All reports must be made in good faith based on information the person reporting the incident reasonably believes to be accurate. We may request additional information from the person reporting the incident throughout the course of the review of the report. We will take appropriate action to ensure compliance with our policies. The reviewing body will impose any sanctions that it feels are fair, just, and reasonable under all circumstances. We will not allow anyone to retaliate against any person for making a report in good faith or providing information in connection with an investigation into an alleged violation. Any information provided during a grievance report review will be treated confidentially. Similarly, any actions that are taken in response to the report will also be confidential.
Audit Policy
Students may return and audit the program that they have completed, assuming all prior financial responsibilities have also been fulfilled. We offer two audit options. Once you decide to attend, please let us know at least two weeks of notice so that we can save you space and include you in the meal counts.
Audit/Observer is tuition-free. When selecting this option, students are to observe the class in silence. They are welcome to take notes, but they are not to contribute with comments or questions (unless invited by the lead teacher). This option is only available to graduates.
Audit/Participant at 50% of the current tuition cost. When selecting this option, students may participate in all discussions, group activities, practice teaching, etc. This option is available for graduates as well as non-graduates who have already attended the portion of the training they wish to audit.
Auditing students must cover their accommodations (room and board) while on the property. If staying off-campus, the commuter fee of $55/day applies (including all meals and property access). Furthermore, students may consider becoming of service (Seva) while auditing, so please inquire with the staff about any chores you might want to cover. Remember that when you come to audit, you are a representation of the teachings. We ask that you carry yourself as such: be respectful, be of service in any way that presents itself, look presentable, and support the teachers/teachings. To the students, you are modeling what a graduate looks like.
Auditing at a hosting studio may not be available due to space limitations related to Covid-19. Please check in advance with a CYS staff member. If space is available, please consider being of service to the studio while auditing and help in some manner: clean up, contribute toilet paper, etc. Please check the shala calendar for programs being offered at hosting locations since that is not a regular offering.
Video and Photography Policy
During each intensive, much of the content will be recorded so that it can be uploaded to the training site and shared with you, your fellow students, and program graduates. There may be photos taken for marketing purposes. If you have any concerns regarding being recorded or photographed, please let staff and your trainers know before the start of the first intensive or at any time during the training.
Private Training Site Policy
The Training Site is a private site that houses your manual and other video resources that you must access as part of your training. This is also the location where you will be posting your homework. We encourage you to take advantage of this resource as early as possible.
You may not receive any printed materials as part of the training, but you are free to print anything you may need from the training site and use it as a reference.
Upon application, acceptance, and payment, you will receive an email invitation from a staff member to access this site. At that point, you must create a WordPress account. If you don’t receive an invite before the start of the first intensive, please let your teacher/contact know. You are required to use your first and last name as your screen name for WordPress, so we know who is posting comments, and therefore, you get credit for your work. Important: WordPress is your password keeper, not Circle Yoga Shala. If you forget your password, you must reset it with WordPress.
Your free membership to the Training Site will continue for 3 months after you graduate from the program. After that, you may continue your access for a yearly fee. We encourage you to go back and refer back to it as often as possible, as new content continues to be added from each graduating cohort.
If you don’t complete the program, your access to the Training Site will be revoked immediately.

Anti-Harassment Policy
We do not permit staff members, trainers, teachers, students, or others in the workplace to harass any other person because of age, gender (including pregnancy), race, ethnicity, culture, national origin, religion, sexual orientation, disability, socioeconomic status, genetic information, or any other basis proscribed by law.
Anti-Discrimination Policy

Sexual Harassment in the Workplace
We do not tolerate sexual harassment in our location. Sexual harassment refers to any unwelcome sexual attention, sexual advances, requests for sexual favors, and other verbal, visual, or physical conduct of a sexual nature when the conduct harms the person’s employment or working environment.
Sexual Misconduct Policy
We prohibit sexual misconduct in our school. Sexual misconduct is any unsolicited and unwelcome sexual advances including requests for sexual favors, sexual touching, and verbal, visual, or physical conduct that creates a sexually hostile environment on the property.
Romantic Relationships Between Teachers and Students
Teachers shall not invite, respond to, or allow any sexual or romantic conduct with a student during the period of the teacher-student relationship.
Anti-Retaliation Policy
We prohibit retaliation against anyone for reporting a violation of our Code of Conduct or other policies or for participating in an investigation relating to a violation of our Code of Conduct or other policies.
IAYT Member Policy
Students are encouraged to become IAYT members. Your membership supports your growth and understanding of yoga therapy while contributing to developing and disseminating yoga therapy as a healing art and science. Additional details are available on the IAYT website.
Note: The IAYT Membership is different from the IAYT Yoga Therapy Certification! Membership is available to anyone interested in Yoga Therapy; the only requirement is due payment. Certification as a Yoga Therapist requires graduation from an IAYT-Accredited program.
Property Waiver
To participate in any activity at the shala, you must agree with the property waiver.
In consideration of the risk of injury or illness while participating in yoga classes and/or yoga training, horse activities, the wilderness, movement, WWOOFing, meditation, gardening, meals, swimming, floating, sauna, cold plunge and any other activity offered or available at Circle Yoga Shala (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Circle Yoga Shala, located at HC 70 Box 544, Jasper, Arkansas 72641, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economic or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM AS WELL AS PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT IS NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE CONDITION OF THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN OR UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY, INCLUDING TRAVEL TO, FROM AND DURING THIS ACTIVITY.
I agree to indemnify and hold harmless Circle Yoga Shala against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Circle Yoga Shala incurs any of these types of expenses, I agree to reimburse Circle Yoga Shala.
I acknowledge that Circle Yoga Shala and their directors, officers, volunteers, representatives, and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Circle Yoga Shala.
I ACKNOWLEDGE THAT THIS ACTIVITY MAY INVOLVE A TEST OF A PERSON'S PHYSICAL AND MENTAL LIMITS AND MAY CARRY WITH IT THE POTENTIAL FOR DEATH, SERIOUS INJURY, AND PROPERTY LOSS. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE Circle Yoga Shala AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST Circle Yoga Shala FOR PERSONAL INJURY OR PROPERTY DAMAGE.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Circle Yoga Shala, its agents, and employees.
In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
This Agreement was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant,and Circle Yoga Shala agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.
